DUI ACCIDENT WITH INJURY LAWYER IN FULLERTON

DO I FACE A FELONY OR A MISDEMEANOR DUI CHARGE?

Driving under the influence (DUI) of alcohol in the state of California can be a serious crime, especially if complicated by an accident in which one or more individuals was injured. DUI with injury, found under Vehicle Code 23153, is one of a handful of offenses under California state law known as "wobblers" - meaning it could be charged either as a misdemeanor or a felony. The level of the charge depends on a number of factors, including the situation in which you were arrested and any prior convictions on your record.

If you are convicted of a misdemeanor DUI with injury, you could face the following penalties:

  • Probation, between 3 and 5 years

  • Incarceration, between 5 days and 1 year

  • Fines, between $390 and $5,000, plus restitution

  • Mandatory attendance in an alcohol program

  • Driver's license suspension, between 1 and 3 years

Felony DUI with injury carries even more severe penalties. These consequences may include:

  • Incarceration, between 16 months to 10 years, in addition to another sentence of 1 to 6 years in California state prison depending on the severity of the injuries sustained and the number of victims injured

  • One or more "strikes" on your criminal record

  • Fines, between $1,015 and $5,000, plus restitution

  • Mandatory attendance in an alcohol program

  • Status as a habitual traffic offender (HTO) for 3 years
